Reminder: Nov. 1 Deadline to Submit CBI Substantiations for Notices of Activity Form A

If your company filed a retrospective activity notice (Notice of Activity Form A) under the Toxic Substances Control Act (TSCA) Inventory Notification (Active-Inactive) Rule and claimed the specific chemical identity as confidential business information (CBI), you have until November 1, 2020, to submit or amend your CBI substantiations. Companies that amend, update, or file new CBI substantiations must do so electronically via EPA’s Central Data Exchange: https://cdx.epa.gov/.

Background

Section 8(b) of TSCA required EPA to establish a rule on CBI claims for specific chemical identities for chemicals reported as “active” in U.S. commerce in response to the TSCA Inventory Notification (Active-Inactive) Rule.

On February 19, 2020, EPA finalized a rule on the procedures for companies to substantiate their CBI claims for specific chemical identities of substances on the TSCA Inventory. Companies that filed a Notice of Activity Form A and claimed specific chemical identities as CBI have 180 days from the effective date of the final CBI rule, or until November 1, 2020, submit or amend their CBI substantiations.
