Request for AIS Waiver for CWSRF Emergency Relief and DWSRF Urgent Need Projects for the State of Texas

EPA is not approving the Texas Water Development Board request for a public interest waiver of the AIS requirements for CWSRF and DWSRF projects. Based on the Agency’s analysis of the waiver request, and in response to overwhelming opposition from public comments, the Agency cannot approve the waiver requested because the Agency does not have information to support that any shortage of domestic products may affect the projects of concern. The Agency has observed, and public comments support, that domestic supply of the majority of iron and steel products are readily available for potentially affected SRF projects. (Not Approved on April 18, 2018)
