This memo responds to the request for a deviation from 40 CFR 35.3520 (e)(3), which prohibits DWSRF financing of reservoirs. This deviation would allow the state of Texas to use DWSRF financing for a raw water reservoir/settling basin with a 32-day retention time in Anahuac, TX.
