This memo responds to the request for a deviation from 40 CFR 35.3520(e)(3), which prohibits DWSRF financing of reservoirs. This deviation would allow the state of Ohio to use DWSRF financing for a pretreatment reservoir with a 30-day capacity to address turbidity and elevated nitrate levels in Defiance, OH.
