Case Summary: EPA Funded Sites and Communities in the Chemtura Bankruptcy Settlements

The 2010 bankruptcy settlements between the U.S. and Chemtura provide for the payment of funds in connection with 18 sites and facilities throughout the country. The payments for these sites will address a wide variety of environmental contamination.

The following is a brief overview of the sites and facilities addressed by the settlement agreement.

Beacon Heights Landfill Superfund Site, Beacon Falls, CT

Site Description

  • The Beacon Heights Landfill site covers 34 acres on an 83-acre property in New Haven County, CT.

Funding Level

  • Payment to the U.S. of a total of $4,800,000 ($3,800,000 in cash and $1,000,000 as an allowed general unsecured claim).

Bio-Lab, Inc. facility, Conyers, GA

Site Description

  • Bio-Lab, Inc., is a pool and spa care company located in Conyers, Georgia, about 30 miles east of Atlanta. The local address is 1700 Old Covington Highway, Conyers, Rockdale County, Georgia.

Penalty Information

  • Payment to the U.S. of $785,714 as an allowed general unsecured claim for civil penalties at this site stemming from alleged violations of CERCLA, the Clean Air Act, the Clean Water Act, and the Emergency Planning and Community Right-to-Know Act.

Central Chemical Superfund Site, Hagerstown, MD

Site Description

  • The Central Chemical Site consists of a 19-acre parcel of land located in Hagerstown, Maryland.

Funding Level

  • Payment to the U.S. of $150,000 as an allowed general unsecured claim.

Cleve Reber Superfund Site, Sorrento, LA

Site Description

  • The Cleve Reber site covers 25 acres near Sorrento, Louisiana, in Ascension Parish, about 25 miles southeast of Baton Rouge. Wastes were dumped at the site in the early 1970s until it was abandoned in 1972. From 500 to 600 barrels are visible on the surface.

Funding Level

  • Payment to the U.S. of a total of $145,000 ($125,000 in cash and $20,000 as an allowed general unsecured claim).

Cooper Drum Co. Superfund Site, South Gate, CA

Site Description

  • The Cooper Drum Superfund Site is a 3.8-acre facility located at 9316 South Atlantic Avenue in South Gate, California. The Site is in an urban area of mixed industrial, commercial and residential uses. Rayo Avenue borders the site to the east and the former Tweedy Elementary School property is located directly to the south.

Funding Level

  • Payment to the U.S. of a total of $1,110,000 ($710,000 in cash and $400,000 as an allowed general unsecured claim).

Delaware Sand & Gravel Landfill Superfund Site, New Castle, DE

Site Description

  • The Delaware Sand & Gravel Landfill site covers 27 acres and is located approximately two miles from the City of New Castle, Delaware. Formerly a sand and gravel quarry, the site is now an inactive industrial waste landfill located adjacent to another National Priorities List site, the Army Creek Landfill.

Funding Level

  • Payment to the U.S. of a total of $1,537,500 ($1,237,500 in cash and $300,000 as an allowed general unsecured claim).

Diamond Alkali Superfund Site, Lower Passaic River Area, NJ

Site Description

  • The Diamond Alkali Superfund Site includes the former pesticides manufacturing plant and surrounding properties at 80 and 120 Lister Avenue in Newark, New Jersey, the Lower Passaic River Study Area, the Newark Bay Study Area and the extent of contamination. The Lower Passaic River Study Area includes the 17-mile tidal stretch of the river from Dundee Dam to Newark Bay, and tributaries.

Funding Level

  • Payment to the U.S. of a total of $8,500,000 in allowed general unsecured claims, including a claim of $7,327,850 on behalf of EPA and a claim of $1,172,150 on behalf of the National Oceanic and Atmospheric Administration.

Gowanus Canal Superfund Site, Brooklyn, NY

Site Description

  • The Gowanus Canal, in Brooklyn, New York, is bounded by several communities including Park Slope, Cobble Hill, Carroll Gardens and Red Hook. The canal empties into New York Harbor.

  • Payment to the U.S. of $3,900,000 as an allowed general unsecured claim.

Great Lakes Chemical Corp. Site, El Dorado, AR

Site Description

  • The Great Lakes Chemical Corporation facility on about 1200 acres southwest of the City of El Dorado, Arkansas.

  • Payment to the U.S. of $45,000 as an allowed general unsecured claim.

Halby Chemical Superfund Site, Wilmington, DE

Site Description

  • The Halby Chemical Site is located within an industrialized section of Wilmington's port area. At least five small businesses are currently located on the property. The nine-acre Site includes a former chemical production area located on the southernmost three acres of the Site, where chemicals were manufactured from 1948 to 1980.

Funding Level

  • Payment to the U.S. of a total of $650,000 ($450,000 in cash and $200,000 as an allowed general unsecured claim.

Interstate Lead Co. Superfund Site, Leeds, AL

Site Description

  • The Interstate Lead Co. (ILCO) site is located approximately 15 miles east of Birmingham, in Leeds, Jefferson County, Alabama. The site consists of the ILCO Main Facility and seven satellite sites located in and around the City of Leeds, where lead-contaminated wastes from the ILCO Main Facility were disposed. The ILCO Main Facility is located on the southwestern side of the city.

Funding Level

  • Payment to the U.S. of a total of $214,111 ($192,752 in cash and $21,359 as an allowed general unsecured claim).

Jadco-Hughes Facility Superfund Site, Belmont, NC

Site Description

  • The Jadco-Hughes Facility covers about 6 acres in Belmont, Gaston County, North Carolina. Chemical wastes were received from industries and reprocessed to recover whatever could be resold. The residues remaining were deposited in a landfill on the site.

Funding Level

  • Payment to the U.S. of $1,584 as an allowed general unsecured claim.

Landia Superfund Site, Lakeland, FL

Site Description

  • The Landia Chemical Company site encompasses a former pesticide manufacturing, blending, and storage facility located at 1405 West Olive Street in Lakeland, Polk County, Florida. The facility operated from 1940 to 1988 and, over that period, operations included formulating and storing a variety of pesticides including organophosphates, organochlorines, and metal-based pesticides such as zinc, copper, and lead oxides.

Funding Level

  • Payment to the U.S. of $711,111 as an allowed general unsecured claim.

Laurel Park Inc. Superfund Site, Naugatuck, CT

Site Description

  • The Laurel Park, Inc. site is a landfill that occupies approximately 20 acres of a 35-acre parcel of land in New Haven County, CT.. The landfill has been in existence since the late 1940s, and several industries disposed of solvents, oils, hydrocarbons, chemical and liquid sludge, chemical solids, tires, and rubber products there.

Chemtura will continue to be responsible for its obligations under a consent decree for the site, including its obligations to perform work and reimburse EPA's costs.

LWD Site, Calvert City, KY

Site Description

  • The LWD site consists of a commercial hazardous waste storage and treatment facility in Calvert City, Kentucky about 130 miles west of Bowling Green, KY.

  • Payment to the U.S. of $2,300 as an allowed general unsecured claim.

Malone Service Co. Superfund Site, Texas City, TX

Site Description

  • The Malone Service Company (MSC) site is located in Texas City, Galveston County, Texas, and encompasses the property formerly used by Malone Service Company, Inc., as a hazardous waste storage, reclamation, and disposal facility. The facility, which covers approximately 150 acres, operated from 1964 until 1996.

Funding Level

  • Payment to the U.S. of $175,000 as an allowed general unsecured claim.

Red Panther Pesticide Superfund Site, Clarksdale, MS

Site Description

  • The Red Panther site is located on 6.5 acres at Normandy and Patton Streets in a commercial/residential area. Liquid and dry herbicides, insecticides, and fungicides were formulated at the Red Panther facility between 1949 and 1978.

Funding Level

  • Payment to the U.S. of $285,000 as an allowed general unsecured claim.

Stauffer-LeMoyne Superfund Site, LeMoyne, AL

Site Description

  • The Stauffer Chemical (LeMoyne Plant) Site is located in Mobile County in Axis, Alabama, approximately 25 miles north of the City of Mobile. The site is adjacent to the Stauffer Chemical (Cold Creek Plant) Superfund Site. The two Sites cover approximately 950 acres. The Cold Creek Plant encompasses about 220 acres and the LeMoyne Plant encompasses 730 acres.

Funding Level

  • Payment to the U.S. of a total of $1,135,141 ($1,049,553 in cash and $85,588 as an allowed general unsecured claim).
