City of Anderson, Indiana, Combined Sewer Overflow Clean Water Act Settlement

On February 18, 2002, a Consent Decree in this matter was entered by the District Court, and subsequently modified on May 18, 2010. The original Decree put the City of Anderson (the City) on an enforceable schedule to:  complete remedial measures by 2009, to address its combined sewer overflows from its sewer system; develop and implement an Emergency Response Plan; to undertake improvements to its Pretreatment Program including an Industrial Survey, and review and make necessary modifications to the permits of its Industrial Users; and, to eliminate one constructed bypass in the system. Under the 2002 settlement, the City is also required to pay civil penalties totaling $250,000 to be divided equally between the United States and the State. The 2010 modification to the Decree extended the 2009 deadline for completion of the combined sewer overflow remedial measures to 2029.

Prior to entry of the original February 18, 2002 settlement, and the May 19, 2010 modification, the settlement and modification were lodged in U.S. District Court of the Southern District of Indiana, and were subject to a 30-day public comment period and final court approval.
