City of Elkhart, Indiana, Combined Sewer Overflow Clean Water Act Settlement

On October 24, 2011, a Consent Decree in this matter was entered by the District Court. The Decree put the City of Elkhart (the City) on an enforceable schedule to:  complete remedial measures (estimated at $155.6 million) by 2029, to address its combined sewer overflows from its sewer system into the St. Joseph and Elkhart Rivers, and Christiana Creek. Under the 2011 settlement, the City is also required to pay civil penalties totaling $87,000 to be divided equally between the United States and the State.

Prior to entry of the October 24, 2011 Decree, the Settlement was lodged in U.S. District Court of the Northern District of Indiana, and were subject to a 30-day public comment period and final court approval.
