Determining and Tracking Substantial Noncompliance with Superfund Enforcement Instruments in SEMS

Memorandum addresses Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) enforcement instruments and

  1. Describes how to categorize CERCLA enforcement instruments by substantial noncompliance (SNC) status, 
  2. Details the scope of compliance tracking in the Superfund Enterprise Management System (SEMS),
  3. Describes the associated compliance monitoring measure, and
  4. Discusses the resulting compliance monitoring process.

Appendices to the memorandum provide examples of SNC (Appendix A) and a summary of SEMS compliance status values (Appendix B). Issued June 29, 2020.

The memorandum supersedes the 2009 "Determining and Tracking Superfund Enforcement Substantial Noncompliance in CERCLIS" memorandum.
