Fuel Waivers

EPA, working with the Department of Energy, responds quickly to address fuel supply disruptions caused by, for example, refinery or pipeline infrastructure damage as the result of a hurricane or other natural disaster, by issuing emergency waivers of certain fuel standards in affected areas. When issued, these temporary waivers are necessary to help ensure that an adequate supply of fuel is available, particularly for emergency vehicle needs.  There were no waivers issued in 2009, 2010, 2013 and 2015.

2020 Fuel Waivers

Nationwide

On March 27, EPA issued a waiver of the federal low volatility “summertime” gasoline requirements nationwide due to issues caused by the COVID-19 outbreak. 2019 Fuels Waivers

Florida

On August 30, 2019, EPA issued a new emergency waiver of the Reid Vapor Pressure (RVP) requirements and Reformulated Gasoline (RFG) commingling prohibitions for the State of Florida. The waiver is effective immediately and continues until September 15, 2019.   Fuel Waiver Concerning Florida.

On August 30, 2019, EPA issued a new emergency waiver to allow the use of red dyed 15 parts per million sulfur non-road locomotive and marine diesel fuel in diesel-powered highway vehicles in the State of Florida.  Fuel Waiver concerning red dyed 15 parts.

  • Related IRS Waiver:  On August 30, 2019, the IRS waived tax penalties when dyed diesel fuel is sold and used for highway use in the State of Florida, effective August 30, 2019 through September 15, 2019.

Pennsylvania

On June 27, 2019, EPA issued a new emergency waiver of the 7.8 Reid Vapor Pressure (RVP) SIP requirements and Reformulated Gasoline (RFG) commingling requirements for Allegheny County, Pennsylvania. The waiver is effective immediately and continues until July 15, 2019. June 27, 2019 Waiver Concerning Allegheny County, PA.

On June 12, 2019, EPA issued a new emergency waiver of the 7.8 Reid Vapor Pressure (RVP) SIP requirements and Reformulated Gasoline (RFG) commingling requirements for Allegheny County, Pennsylvania. The waiver is effective immediately and continues until July 1, 2019. June 12, 2019 Waiver Concerning Allegheny County, PA.

On May 29, 2019, EPA issued an emergency waiver of the 7.8 Reid Vapor Pressure (RVP) SIP requirements and Reformulated Gasoline (RFG) commingling requirements for Allegheny County, Pennsylvania. 2018 Fuels Waivers

Florida

On October 12, 2018, EPA waived the requirement for highway diesel fuel to be free of dye.  This waiver applies to utility, emergency response and other diesel-powered highway vehicles responding to/assisting in recovery efforts in the panhandle area of Florida, through October 26, 2018.  Diesel Fuel Waiver Concerning Florida.

North Carolina

On September 18, 2018, EPA waived the requirement for highway diesel fuel to be free of dye in North Carolina, through September 28, 2018.  Diesel Fuel Waiver Concerning North Carolina.

  • Related IRS Waiver:  On September 18, 2018, IRS waived tax penalties when dyed diesel fuel is sold and used for highway use in North Carolina, effective September 17 through September 28, 2018.

Georgia and Virginia

On September 12, EPA issued an emergency waiver of the Reid Vapor Pressure (RVP) requirements for conventional gasoline in Georgia and the Commonwealth of Virginia, and the low volatility Reformulated Gasoline (RFG) requirements in the following localities and counties within the Commonwealth of Virginia: Charles City County, Chesapeake, Chesterfield County, Colonial Heights, Hampton, Hanover County, Henrico County, Hopewell, James City county, Newport News, Norfolk, Poquoson, Portsmouth, Richmond, Suffolk, Virginia Beach, Williamsburg, and York County.  The waiver of the RVP requirements is effective through the end of the of the high ozone season period on September 15.  The RFG waiver is effective until September 30, 2018.  Fuel Waiver Concerning Georgia and Virginia.

North and South Carolina

On September 11, EPA issued a waiver of the high ozone season federal low volatility “summertime” gasoline requirements in South Carolina and North Carolina, through the end of the of the high ozone season period on September 15.  Fuel Waiver Concerning North Carolina and South Carolina.

Puerto Rico

States in Petroleum Administration for Defense Districts (PADDs) 1, 2, and 3

On September 7, EPA issued a waiver of the federal requirements for low volatility “summertime” gasoline requirements in all east coast states located in PADD 1, all midwestern states located in PADD 2, an all Gulf coast states located in PADD 3.  In addition, EPA waived the Reformulated Gasoline (RFG) requirements in these same states.  This waiver supersedes the August 31 waiver of the gasoline requirements for PADDs 1-3.  Multi-State Fuel Waiver

On August 31, EPA issued a waiver of the requirements for low volatility conventional gasoline and Reformulated Gasoline (RFG) in the following areas, through September 15:  all east coast states located in PADD 1 – Connecticut, Maine, Massachusetts, New Hampshire, Rhode Island, Vermont, Delaware, District of Columbia, Maryland, New Jersey, New York, and Pennsylvania, Florida, Georgia, North Carolina, South Carolina, Virginia, and West Virginia; all midwestern states located in PADD 2 - Illinois, Indiana, Iowa, Kansas, Kentucky, Michigan, Minnesota, Missouri, Nebraska, North Dakota, South Dakota, Ohio, Oklahoma, Tennessee, and Wisconsin; and all Gulf coast states located in PADD 3 – Alabama, Arkansas, Louisiana, Mississippi, New Mexico, and Texas.  The waiver supersedes and expands the areas covered by the August 30 waiver.  Second Multi-State Fuel Waiver

Louisiana

On August 28, 2017, EPA issued an emergency waiver of the Reid Vapor Pressure requirements for the following parishes: Beauregard, Calcasieu, Jefferson, Lafayette, Lafourche, Orleans, Pointe Coupee, St. Bernard, St. Charles, St. James, St. Mary, and the 5 parishes of the Baton Rouge area (Ascension, East Baton Rouge, Iberville, Livingston, and West Baton Rouge), through September 15, 2017.  Fuel Waiver Concerning Louisiana

Texas

On September 13, EPA issued an emergency fuel waiver of the low volatility gasoline, RFG, and Texas Low Emission Diesel (TxLED) requirements that apply in Texas, through October 1, 2017.  Fuel Waiver Concerning Texas

On August 29, 2017, EPA waived the dye required for non-highway diesel fuel in Texas, through September 15, 2017.  Diesel Fuel Waiver Concerning Texas

  • Related IRS Waiver:  On August 30, 2017, IRS waived tax penalties when dyed diesel fuel is sold and used for highway use in Texas, effective August 25 through September 15, 2017.
    ​  
    • Q: Does EPA's August 29, 2017 waiver allow the sale, distribution, and use of dyed 15 ppm sulfur diesel fuel in the entire State of Texas or only in the 110 counties requested by the State of Texas?
    • A: EPA's August 29, 2017 waiver allows dyed diesel fuel with a sulfur level of 15 ppm or lower to be sold, distributed, and used in highway vehicles throughout the entire State of Texas until September 15, 2017.  However, EPA reiterates that the waiver expressly limits the sulfur content to 15 ppm for the dyed diesel fuel allowed under this waiver.  The use of diesel fuel exceeding 15 ppm sulfur could create engine operational problems in addition to harming vehicle emission controls resulting in adverse effects on human health and the environment, and therefore is not allowed under this waiver.

On August 26, 2017, EPA issued an emergency fuels waiver to expand the scope of the August 25 waiver, to cover all reformulated gasoline (RFG), low Reid Vapor Pressure (RVP) and Texas Low Emission Diesel (TxLED) requirements that apply throughout eastern Texas, through September 15, 2017.  Expanded Fuel Waiver Concerning Texas

On August 25, 2017, EPA issued an emergency waiver of the Reid Vapor Pressure and Reformulated Gasoline requirements for parts of eastern and coastal Texas, and to allow federal Ultra Low Sulfur Diesel (ULSD) fuel to be used in 29 counties in eastern Texas where Texas Low-Emission Diesel (TxLED) fuel is required, through September 15, 2017.  Fuel Waiver Concerning Texas

2012 Fuels Waivers

New York and New Jersey

On November 16, EPA extended the multi-state waiver of RFG requirements in NY and NJ, and the waiver of diesel fuel requirements in NY and NJ, through December 7. Fuel Waiver Concerning New York and New Jersey 

  • Related IRS Waiver: On November 20, 2012, in response to continuing shortages of clean diesel fuel caused by Hurricane Sandy, the IRS waived tax penalties when dyed diesel fuel is sold for use or used highway, and for the use of diesel fuel that does not meet EPA sulfur requirements, in New York and New Jersey through December 7, 2012.

New York and Pennsylvania

On November 2, EPA waived the requirement for use of Ultra Low Sulfur Diesel in emergency response vehicles and equipment in the five boroughs of New York City and Nassau, Suffolk, Rockland and Westchester counties in New York, and in the Commonwealth of Pennsylvania, as the result of Hurricane Sandy through November 20, 2012.  Fuel Waiver Concerning New York and Pennsylvania 

  • Related IRS Waiver: On November 3, 2012, in response to shortages of clean diesel fuel caused by Hurricane Sandy, the IRS waived tax penalties when dyed diesel fuel is sold for use or used highway, and for the use of diesel fuel that does not meet EPA sulfur requirements, in New York, New Jersey and Pennsylvania, through November 20, 2012.

Alabama, Connecticut, Delaware, District of Columbia, Georgia, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, South Carolina, Tennessee and Virginia

On October 31, due to pipeline disruptions distributing fuel to the northeast, EPA waived requirements for the use of Reformulated Gasoline in the following states: Connecticut, Delaware, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Virginia and the District of Columbia. In addition, also waived were additional requirements prohibiting "blending" of certain types of gasoline, applicable in each of these states, as well as in Mississippi, Alabama, Georgia, Tennessee, South Carolina, and North Carolina, to facilitate distribution of fuel to areas affected by Hurricane Sandy, through November 20, 2012.   • Q: Are parties who produce, import or distribute gasoline under the EPA's October 31, 2012, multi-state waiver required to add ethanol to gasoline blends?
  • A: No. In the states covered by the multi-state waiver, parties can produce, import and distribute gasoline from CBOB, RBOB, RFG and conventional gasoline without blending oxygenates, including ethanol. (If supplies are available, EPA recommends blending ethanol, but it is not required under the waiver.) Parties who produce, import and distribute gasoline for sale in the areas covered by the waiver must ensure that the gasoline that they sell and distribute meets all other applicable standards.

New Jersey

On November 1, EPA waived the requirement for use of Ultra Low Sulfur Diesel in emergency response vehicles in New Jersey, as the result of Hurricane Sandy through November 20, 2012. Fuel Waiver Concerning New Jersey

Nationwide fuel waiver issued to bolster fuel supplies

On Aug. 31, EPA waived the requirement to sell "summer gasoline" which contains a lower volatility limit. This action has the effect of allowing early use of wintertime gasoline. EPA is also allowing the use of diesel fuel that exceeds 500 ppm sulfur content. Both waivers were effective through Sept. 15 and were applicable throughout all 50 states, U.S. territories and the District of Columbia. Phoenix, Arizona
