Guidance: Issuing Superfund 104(e)(2) Information Requests to Federal Agencies at Privately-Owned Sites

Transmittal memorandum and guidance to assist the Regions with managing Superfund cases that have federal agency potentially responsible parties (PRPs). Guidance highlights the importance of sending Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) section 104(e)(2) information requests to federal agencies that are potentially responsible parties (Fed PRPs) for privately-owned sites, including formerly used defense sites (FUDS), formerly utilized site remedial action program sites (FUSRAP) and mixed ownership sites.
