Guidance: Policy for Municipality and MSW CERCLA Settlements at NPL Co-Disposal Sites

Policy addresses settlement options at co-disposal sites for parties whose liability relates to municipal solid waste (MSW) The policy is intended to provide a fair, consistent, and efficient settlement methodology for resolving the potential liability under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) of generators and transporters of municipal sewage sludge and/or municipal solid waste at co-disposal landfills on the National Priorities List (NPL), and municipal owners and operators of such sites. Issued 2/5/1989.
