Guidance: Premium Payments in Superfund Settlements

Memorandum provides guidance on the use of premium payments in Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) settlements. OSWER Directive No. 9835.6. Issued 11/17/1988.

Premium payment refers to a risk apportionment device under which the risk taken by the government for providing PRPs with a release from liability not usually available is offset by a payment in excess of the cost projected to complete the remedy.
