Guidance: Superfund Mixed Funding Settlements Involving State or Political Subdivision Preauthorization

Memorandum addresses the Agency's  interim guidance on the use of mixed funding settlements that involve preauthorization of the state or political subdivision that is a potentially responsible party (PRP) at the site. OSWER Directive No. 9834.9a. Issued 5/27/1988. 

The memorandum addresses the question as to whether EPA can approve a request for preauthorization submitted by a political subdivision seeking to file a claim against the Fund for reimbursement of a portion of response costs at a Superfund site.

This memorandum supplements the 10/20/1987 mixed funding evaluation guidance issued under section 122(b) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund.)
