Guidance: Using and Issuing Superfund Section 106(a) Administrative Orders

Memorandum addresses the Agency's use of administrative orders under section 106(a) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund). The administrative enforcement authority is an important component of the Agency's enforcement program authorized under CERCLA. Guidance was developed to assist the regional offices in developing and maintaining an effective CERCLA administrative enforcement program. Issued 9/8/1983.

A portion of this guidance was superseded in part by the 3/7/90 guidance on CERCLA 106(a) unilateral administrative order (UAO) for remedial design/remedial action (RD/RA).
