Guidance: Windfall Lien Administrative Procedures (107(r) Lien) and Model Letter Providing Notice of Intent to File

Transmittal memorandum and attachments addressing implementation of section 107(r) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund), the windfall lien provision on property acquired by a bona fide prospective purchaser (BFPP). The transmittal memorandum includes the model language document Notice of Intent to File a Windfall Lien. Issued 1/8/2008.  

The 2008 guidance builds on the 2003 Interim Enforcement Discretion for Windfall Lien policy regarding the timing for filing notice of a windfall lien on a property after acquisition by a BFPP and the EPA administrative procedures that should accompany filing a windfall lien notice. 

The Agency issued a 4/2008 fact sheet containing answers to frequent questions on the 1/8/2008 administrative procedures guidance for 107(r) liens.

Attachments in this document also include the 7/29/1993 supplemental guidance on federal Superfund liens and a model notice of intent to file a windfall lien letter.
