Lead Renovation, Repair and Painting Rule - December 2014

In December 2014, the U.S. Environmental Protection Agency (EPA) announced 61 enforcement actions that require renovation contractors and training providers to protect people from harmful exposure to lead dust and debris, as required by EPA’s Lead-based Paint Renovation, Repair, and Painting (RRP) standards. The enforcement actions include 55 settlements and six complaints issued between February and October 2014 for renovations performed on pre-1978 homes and child-care facilities.

CDL Commercial, LLC - Overview of Company and Facility Location

CDL Commercial, LLC (the Company) is located in Meriden, Connecticut.  The settlement involves renovation projects conducted at properties located in New Haven, Essex and Meriden, Connecticut.

The Consent Agreement and Final Order (CAFO) settles alleged violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the CAFO, the United States alleges that the Company committed the following violations:

  • Failure to Obtain Firm Certification from EPA.
  • Failure to assign an EPA-certified renovator to the renovations.
  • Failure to provide the owner of the units with the EPA approved pamphlet prior to each of the renovations.
  • Failure to provide the adult occupant of the unit with the EPA approved pamphlet prior to one of the renovations.
  • Failure to retain all records necessary to demonstrate compliance with the rule for a period of three (3) years following completion of the renovation activities.

It is expected that potential lead exposures and environmental contamination will be significantly reduced because the Company has taken prompt steps to come into compliance with the rule.

East Coast Pros, LLC - Overview of Company and Facility Location

East Coast Pros, LLC (the Company) is located in Norwalk, Connecticut. The settlement involves a renovation project conducted at a property located in Norwalk, Connecticut that contained a child-occupied facility.  The property was constructed prior to 1978.

  • Work Practice Requirements. Failure to properly cover the ground at the exterior of the property with plastic sheeting or other disposable impermeable material; failure to properly cover interior surfaces with taped-down plastic sheeting or other impermeable material; and failure to contain waste from renovation activities to prevent releases of dust and debris.
  • Renovation Firm Certification. Failure to obtain initial firm certification from EPA.
  • Renovator Certification Requirements. Failure to obtain a course completion certificate (proof of certification).
  • Notification Requirements. Failure to post signs clearly defining the work area at the property.

  • Failure to Ensure Certification or Training.Failure to ensure that all individuals performing renovation activities on behalf of the firm are either certified renovators or are trained by a certified renovator.
  • Failure to Ensure Certified Renovator Assigned.Failure to ensure that a certified renovator is assigned to each renovation performed by the firm.
  • Failure to Post Warning Signs. Failure to post signs clearly defining the work area and warning persons not involved in the renovation activities to remain outside the work area.

The Complaint alleges violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E.  In the Complaint, the United States alleges that the Company committed the following violations:

  • Failure to obtain initial certification from EPA.
  • Failure to comply with work practice standards by using HEPA air filter exhaust on high speech machinery used to remove lead paint; failing to cover the ground with plastic sheeting or other disposable impermeable material as required; and failing to contain waste from renovation activities as required.
  • Failure to provide written notification or post information signs notifying residents about renovation activities in the common area of the property.
  • Failure to obtain a written acknowledgement that the owner received the EPA Renovate Right lead hazard information pamphlet, or obtain a certificate of mailing of the pamphlet, at least seven (7) days prior to the renovation.
