Lead Renovation, Repair and Painting Rule - May 02, 2013
(Washington, DC - May 2, 2013) – The U.S. Environmental Protection Agency (EPA) today announced 17 enforcement actions for violations of the lead-based paint Renovation, Repair and Painting Rule (RRP). A priority for EPA’s enforcement program is to protect children, and others, from exposure to lead dust that can cause lead poisoning by ensuring that renovators follow the RRP and other lead rules.

Overview of CM Rogers Handyman
CM Rogers Handyman is a contractor located in Manchester, NH. The settlement involves a residential renovation project in July 2011 on a mixed use residential and commercial building in Pittsfield, NH. The property was constructed prior to 1978.
Violations
On October 31, 2012, EPA Region 1 (New England) filed a Consent Agreement and Final Order (CAFO)(Docket# TSCA-01-2012-0071) that simultaneously initiated and resolved an enforcement action against CM Rogers Handyman. The CAFO alleged violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. The CAFO alleged the following violations:
- Failure to Obtain Firm Certification. The United States alleged that CM Rogers Handyman violated the RRP Rule by failing to obtain initial firm certification from EPA prior to performing, or offering to perform, renovation activities in housing constructed prior to 1978.
- Failure to Provide Lead Hazard Information to the Property Owners. The United States alleged that CM Rogers Handyman violated the RRP Rule by failing to notify in writing each affected unit including a statement of how the occupant can obtain a copy of the Renovate Right pamphlet.
- Failure to Post Signs Defining Work Area. The United States alleged that CM Rogers Handyman violated the RRP Rule by failing to post signs clearly defining the work area.
- Failure to Comply with Work Practice Requirements. The Unites States alleged that CM Rogers Handyman violated the RRP Rule by failing to contain waste from the renovation activities.
Pollutant Reductions
CM Rogers Handyman has certified in the CAFO that is has come into compliance with the firm certification, information distribution, and work practice requirements of the RRP Rule. This will assure property owners and agencies enforcing the RRP Rule that painting and renovation activities are conducted in compliance with the regulation.
Health and Environmental Effects
Lead exposure affects the nervous system and can cause a range of health effects, from behavioral problems and learning disabilities, to seizures and death. Children six years old and younger are most at risk. If not detected early, children with high levels of lead in their bodies can suffer from:
- Damage to the brain and nervous system;
- Behavior and learning problems, such as hyperactivity;
- Slowed growth;
- Hearing problems;
- Headaches;
- Anemia; and/or
- In rare cases of acute lead poisoning from ingestion of lead, seizures, coma and even death.
Lead can accumulate in our bodies over time, where it is stores in bones along with calcium. During pregnancy, lead is released from bones as maternal calcium is used to help form the bones of the fetus. This is particularly true if a woman does not have enough dietary calcium. Lead can also be easily circulated from the mother's blood stream through the placenta to the fetus. Mothers with high levels of lead in their bodies can expose their developing fetuses, resulting in serious and developmental problems including:
- Miscarriages,
- Premature births or low birth weight,
- Brain damage, decreased mental abilities and learning difficulties, and/or
- Reduced growth in young children.
Civil Penalty
CM Roger Handyman is a micro-business. Based on financial information provided by CM Roger Handyman, EPA Region 1 determined that the firm did not have an ability to pay a penalty and entered into a settlement under which the firm certified that it has come into compliance with the RRP Rule.
Overview of New Hampshire Plate Glass Corporation
New Hampshire Plate Glass Corporation (NH Glass) is a firm located in Portsmouth, New Hampshire. The complaint was filed February 1, 2013, and concerns a window renovation project NH Glass was performing at a former school in Kittery, Maine. The school was being converted to a community center that would also house child day-care programs, and thus is a “child-occupied facility” subject to the Renovation, Repair and Painting Rule (RRP Rule). The property was constructed prior to 1978.
Violations
The complaint alleges violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule, 40 C.F.R. Part 745, Subpart E. The complaint alleges NH Glass failed to comply with the following RRP Rule work practice requirements:
- Failure to assign a certified renovator to the work site;
- Failure to cover ground with plastic sheeting; and
- Failure to contain waste from renovation activities.

Reeson Construction is a contractor located in Webster, New Hampshire. The settlement involves a renovation project at a child-occupied, single family house in Concord, NH. EPA, and state officials inspected the work-site in August 2011. The property was constructed prior to 1978.
Violations

Accolade Construction Group, Inc. is a building contractor with its main office located in New York, New York. The settlement involves a residential renovation project conducted at a property in New York City in 2011. The property was constructed prior to 1978.
Violations

PZ Painting is a painting company that with its main office located in Springfield, New Jersey. The settlement involves a residential renovation project conducted at a home in New Jersey in June 2012. The property was constructed prior to 1978.

Violations
The Consent Agreement and Final Order (CAFO) settles alleged violations of the Toxic Substances Control Act (“TSCA”), the Residential Lead-Based Paint Hazard Reduction Act, and the Renovation, Repair and Painting Rule (“RRP Rule”), 40 C.F.R. Part 745, Subpart E. The CAFO alleges the following RRP Rule violations:
- Failure to Obtain Firm Certification. The United States alleges that Cherokee Home Improvements violated the Renovation, Repair, and Painting Rule by failing to obtain firm certification from EPA prior to performing, or offering to perform, renovation activities in housing constructed prior to 1978.

Camaj Interior & Exterior has made efforts to come into compliance with the certification requirements of RRP. This will assure property owners and agencies enforcing the RRP Rule that painting and renovation activities have been conducted as required by the RRP regulations.
Health and Environmental Effects
Lead exposure affects the nervous system and can cause a range of health effects, from behavioral problems and learning disabilities, to seizures and death. Children six years old and younger are most at risk. If not detected early, children with high levels of lead in their bodies can suffer from:
- Damage to the brain and nervous system
- Behavior and learning problems, such as hyperactivity
- Slowed growth
- Hearing problems
- Headaches
- Anemia
In rare cases of acute lead poisoning from ingestion of lead, seizures, coma and even death. Lead can accumulate in our bodies over time, where it is stores in bones along with calcium. During pregnancy, lead is released from bones as maternal calcium is used to help form the bones of the fetus. This is particularly true if a woman does not have enough dietary calcium. Lead can also be easily circulated from the mother's blood stream through the placenta to the fetus. Mothers with high levels of lead in their bodies can expose their developing fetuses, resulting in serious and developmental problems including:
- Miscarriages,
- Premature births or low birth weight,
- Brain damage, decreased mental abilities and learning difficulties, and/or
- Reduced growth in young children.
Civil Penalty
Camaj Interior & Exterior will pay a penalty of $200. Camaj’s penalty was reduced because it qualified as a micro-business under the Pilot RRP Penalty Program for Micro-Businesses.
Overview of Henderson & Associates Services, LLC
Henderson & Associates Services, LLC is a renovation firm with its main office in Largo, FL. The settlement involves two residential renovation or repair projects conducted in Clearwater, Florida between May 2010 and January 2011. Both properties were constructed prior to 1978.
Violations
The Expedited Settlement Agreement (“ESA”) and Final Order settles alleged violations of the Toxic Substances Control Act (“TSCA”), the Residential Lead-Based Paint Hazard Reduction Act, and the Renovation, Repair and Painting Rule (“RRP Rule”), 40 C.F.R. Part 745, Subpart E. The ESA alleges the following RRP Rule violation:
- Failure to Obtain Firm Certification. The United States alleges that Henderson & Associates violated the Renovation, Repair, and Painting Rule by failing to obtain firm certification from EPA prior to performing, or offering to perform, renovation activities in housing constructed prior to 1978.
- Failure to Establish and Maintain Records. - Failure to Assign a Certified Renovator. The Unites States alleges that Henderson & Associates violated the Renovation, Repair, and Painting Rule by failing to assign a certified renovator to a RRP regulated activity.
- Failure of the Individual Renovator to Obtain Certification. The Unites States alleges that Daryl Henderson violated the Renovation, Repair, and Painting Rule by failing to obtain individual renovator certification from EPA prior to performing, or offering to perform, renovation activities in housing constructed prior to 1978. li>

Home Resources Management, LLC is a renovation and resale firm with its main office in Nashville, TN. The settlement involves residential renovation or repair projects conducted on property that was constructed prior to 1978.

The United States alleges that Midwest College Painters violated the Renovation, Repair and Painting Rule by failing to provide a copy of the “Renovate Right” pamphlet to the property owner prior to commencing renovation activities.
- Failure to Establish and Maintain Records. The Unites States alleges that Midwest College Painters violated the Renovation, Repair, and Painting Rule by failing to establish and maintain records certifying that a certified renovator was assigned to the project, provided on-the-job training to individuals used on the project, and directed these individuals performing the renovation to comply with the work practice standards required by the RRP rule.
- Failure to Comply with Work Practice Standards. The United States alleges that Midwest College Painters violated the Renovation, Repair, and Painting Rule by failing to take steps to contain paint dust from renovation work as required by the RRP Rule.

Each of the properties was subject to the federal renovation requirements because they were constructed prior to 1978 and presumed to contain lead-based paint.

The settlement involves residential painting and renovation projects conducted at a multiple family residential property in St. Louis, MO. The property and each unit were subject to the federal renovation requirements because they were constructed prior to 1978 and presumed to contain lead-based paint.
Violations
