On June 3, 2020, EPA issued a No Action Assurance setting forth the conditions under which applicable new industrial facilities would operate with respect to stormwater discharges in the period between the June 3, 2020 expiration of EPA’s 2015 Multi-Sector General Permit (MSGP) and the effective date of the agency’s 2020 MSGP (anticipated no later than December 2020). The eligibility requirements, conditions, and duration of the No Action Assurance as well as background information are set forth in the attached memorandum.
