Use of "Look-First" Approach in Superfund Settlement Agreements Involving Third Parties

Memorandum, developed under Recommendation 22 of the Superfund Task Force, addresses the use of a "look-first" provision in settlement agreements under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund) involving potentially responsible parties, the government, and a third-party who agrees to perform cleanup work at a site.
