How will engineering reports be treated in terms of public access and CBI? Will there be web access for submitted reports?

EPA will process any public requests for engineering reports on a case-by-case basis and there will be no general web access to the engineering reports.

Engineering reports, or portions thereof, for which the submitter asserts a confidential business information (CBI) claim will be protected from public disclosure as specified in 40 CFR Part 2, subpart B.

Engineering reports, or portions thereof, for which no CBI claim is made may be released to the public in response to a Freedom of Information Act request pursuant to EPA regulations at 40 CFR Part 2, subpart A.
