Overview of the Award Document and Terms and Conditions
The award document includes the following components:
- EPA assistance application, including the approved work plan/narrative (by reference);
- EPA assistance agreement document; and
- EPA regulations (by reference)
The assistance agreement award document contains various terms and conditions and is a legally binding agreement between EPA and the recipient organization. There are three types of terms and conditions: administrative, programmatic, and high-risk.
Administrative Terms and Conditions
Administrative terms and conditions are based on applicable provisions of the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards (2 CFR 200) as well as other pertinent laws and regulations.
Example of an administrative term and condition:
In accordance with EPA guidance and 2 CFR 200.450 Lobbying, as appropriate, the recipient agrees that it will not use assistance funds (federal or non-federal share) for lobbying or political activities.
Programmatic Terms and Conditions
Programmatic terms and conditions are provided by the EPA program office that supports the grant.
Example of a programmatic term and condition:
The recipient agrees to submit quarterly progress reports to the EPA project officer within thirty days after each reporting period.
Programmatic terms and conditions also include substantial involvement terms and conditions that refer to activities that will be performed by the EPA, usually the project officer, if the grant is supported as a cooperative agreement.
Example of a substantial involvement term and condition:
The EPA project officer will participate in planning sessions for each phase of the project for the purpose of providing technical input.
Additional Terms and Conditions
Additional terms and conditions may be used for specific awards. For example, if a recipient:
- has a history of failure to comply with the general or specific terms and conditions of a Federal award;
- fails to meet expected performance goals; or
- is not otherwise responsible.
