Guidance: Demonstrating Compliance with the Land Disposal Restrictions (LDR) Alternative Soil Treatment Standards

This guidance provides suggestions and perspectives on how members of the regulated community, states, and the public can demonstrate compliance with the alternative treatment standards for certain contaminated soils that will be land disposed and, therefore, will be subject to the RCRA LDR regulations. On May 26, 1998, EPA promulgated land disposal restriction treatment standards specific to contaminated soils. See volume 63 of the Federal Register (FR) page 28555 and title 40 of the Code of Federal Regulations (CFR) section 268.49. Under these regulations, when disposing of contaminated soils, you may elect to comply with either the alternative soil treatment standards at 40 CFR section 268.49 or the generic treatment standards at 40 CFR section 268.40 which apply to all hazardous wastes.
