Where are the Management Standards for Hazardous Waste Pharmaceuticals and Amendment to the P075 Listing for Nicotine in Effect?
On February 22, 2019, EPA issued a rule that establishes streamlined standards designed specifically for the health care sector. These standards will protect human health and the environment while bringing efficiencies and cost-savings to the sector. The rule also amends the P075 hazardous waste listing for nicotine such that Food and Drug Administration (FDA)-approved over-the-counter nicotine replacement therapies (i.e., nicotine patches, gums and lozenges) will no longer be considered hazardous waste when discarded.
Subpart P must be adopted by all authorized states, whereas adoption of the amendment to the P075 listing for nicotine is optional for authorized states. Because of these differing adoption and authorization requirements, these components will be tracked on separate maps.
This final rule also prohibits the sewering (e.g., flushing, pouring down the drain) of all hazardous waste pharmaceuticals by all healthcare facilities and reverse distributors. The sewering prohibition is effective in all states, territories and Indian Country on August 21, 2019.

Map of Where the Management Standards for Hazardous Waste Pharmaceuticals are in Effect
The map below shows which states have adopted the Management Standards for Hazardous Waste Pharmaceuticals final rule (found in subpart P of part 266 in Title 40 of the Code of Federal Regulations) and which states have been authorized by EPA to implement it. New rules go into effect in a state when a state adopts them into state law. When EPA authorizes a state for a new rule, EPA reviews the new state regulations subsequent to adoption to ensure they are equally as stringent as, or more stringent than the federal regulations. EPA authorizes states through a final rule and can then enforce authorized state rules. See the State Authorization page for further information about the State Authorization program.
