Federal Register Notice: Exclusions to the Definition of Solid Waste for Certain In-Process Recycled Secondary Materials in the Petroleum Industry and Certain other Reclaimed Sludges, By-Products, and Spent Materials Proposed Rule

This notice, published on January 8, 1988,  provides the Agency's interpretation of the court's opinion in American Mining Congress v. EPA, 824 F.2d 1177, and describes the portions of the regulations unaffected by the opinion and remaining in force. This notice also proposes amendments to the rules required by the court's opinion. In general, the Agency is proposing to exclude from regulation certain in-process recycled secondary materials in the petroleum refining industry, and certain other sludges, byproducts, and spent materials that are reclaimed as part of continuous, ongoing manufacturing processes.
