On August 21, 1985, EPA published a notice of proposed rulemaking to amend the financial responsibility requirements concerning liability coverage for owners and operators of hazardous waste treatment, storage, and disposal facilities (volume 50 of the Federal Register starting on page 33902). The proposal set forth several regulatory options under consideration by the Agency to provide relief for owners and operators who have encountered difficulties in obtaining insurance necessary to comply with these requirements. EPA amended these requirements in interim final form to allow use of one additional financial responsibility mechanism: a corporate guarantee.
