Summary

Statement of Basis for Proposed Corrective Measures

The U.S. Environmental Protection Agency (EPA) Region 7, 11201 Renner Boulevard, Lenexa, KS 66219, is providing Public Notice regarding issuance of a Statement of Basis for the former SMV Industries facility, 1103 South 6th Street, Council Bluffs, Iowa (EPA ID No. IAD984566034).

EPA has reviewed facility investigation documents for the former SMV Industries facility and has selected a remedy for residual contaminated media at the property. EPA is issuing a Statement of Basis for these proposed corrective measures, which consist of institutional controls in the form of property activity and use limitations. Activity and use limitations are site restrictions that provide protection from contamination and also prescribe actions if contaminated media are encountered.

These limitations include the following conditions: 1) no residential land use; 2) no use of on-site groundwater as a potable water supply; 3) no soil excavation or removal in the restricted area without regulatory agency notification and appropriate protective measures; and 4) the requirement for structures constructed on the property to be engineered to address vapor intrusion, unless sufficient testing is performed by the property owner prior to construction that demonstrates no vapor intrusion concern.

Comments should be submitted prior to the expiration of the public comment period, which ends on June 26, 2020.

An EPA public hearing has not been scheduled; however, if requests are received that indicate significant public interest in the Statement of Basis, a public hearing will be scheduled. Requests for a public hearing must be made in writing to the EPA contact listed above and must state the nature of issues proposed to be raised at the hearing. Such requests should be submitted prior to June 26, 2020.

After consideration of all comments received, and of the requirements of the Resource Conservation and Recovery Act, EPA will make a Final Remedy decision. If the decision is made to select a Final Remedy that is substantially unchanged from that described in the Statement of Basis and made available for public comment as announced by this notice, EPA will notify all persons submitting comments or requesting a notice of the final decision. If the selected remedy is substantially changed from that described in the Statement of Basis, EPA will issue a public notice indicating the changes.
