Summary

Proposed Remedy and Permit Modification

The U.S. Environmental Protection Agency (EPA) Region 7 invites the public to comment on the Proposed Remedy and Permit Modification for the John Deere Waterloo Works – Drivetrain Operations Facility, located In Waterloo, Iowa (EPA ID No. IAD005289806). This Public Notice is being conducted as required by the Resource Conservation and Recovery Act (RCRA) Corrective Action-Only Hazardous Waste Operating Permit.

The RCRA Corrective Action-Only Permit requires an investigation of environmental conditions at the facility. Based on information currently available, EPA has developed a Proposed Agency Decision (Statement of Basis) with an Administrative Record, which includes all documents supporting the Proposed Decision. EPA will make a Final Decision after considering all comments. Following the public notice, the permit will be modified to incorporate this remedy modification selected by EPA.

EPA encourages the public to review the Administrative Record at the EPA Region 7 Records Center, 11201 Renner Boulevard, Lenexa, KS 66219; or the Waterloo City Hall, 2nd Floor, Planning and Zoning Department, 715 Mulberry Street, Waterloo, IA 50701; or it can be made available on CD upon request.

Persons wishing to comment on EPA’s Proposed Remedy Modification, summarized in the Statement of Basis, should submit comments to EPA within the 45-day public comment period beginning May 27, 2020, and ending July 13, 2020. All comments must be submitted in writing by mail or email to the EPA Project Manager listed below.

EPA will consider all comments before making a Final Decision. If the decision is substantially unchanged from the one summarized in the Statement of Basis, EPA will issue a Final Decision and inform all persons who submitted written comments or requested notice of EPA’s decision. If the Final Decision is significantly different from the one proposed, EPA will issue a public notice explaining the new Proposed Decision and reopen the comment period.

A public hearing has not been scheduled. However, if requests are received that indicate significant public interest in the Proposed Final Remedy and Permit Modification, a public hearing will be scheduled. Requests for a public hearing must be made in writing to the EPA Project Manager at the address listed below and must state the nature of the issues proposed to be raised at the hearing. Such requests should be submitted prior to July 13, 2020.
