Summary

(1) Unauthorized discharge of stormwater into waters of the United States in violation of Section 301(a) of the Act, 33 U.S.C. § 1311(a), and failure to apply for a National Pollutant Discharge Elimination System ("NDPES") permit for the discharge of stormwater associated with industrial activity in violation of Section 308 of the CWA, 33 U.S.C. § 1318(a); (2) Failure to prepare a Spill Prevention, Control, and Countermeasure ("SPCC") Plan in accordance with the requirements of 40 C.F.R Part 112 in violation of Section 311 of the CWA, 33 U.S.C. § 1321; and (3) Violation of the general pretreatment regulations at 40 C.F.R. Part 403 in violation of Section 307(d) of the Act, 33 U.S.C. § 1317(d).
