Public Notice: Opportunity to Comment on Proposed Permit for City of Eagle Butte Wastewater Treatment Facility

Summary

The purpose of this notice is to state EPA’s intention to issue a National Pollutant Discharge Elimination System (NPDES) permit under the authority of Section 402 of the Clean Water Act. This is a second public comment period for this permit to allow for public comment on changes made to the permit as a result of the comments received during the first public comment period.

Activity

Discharge of treated wastewater from the City of Eagle Butte Wastewater Treatment Facility flows into Green Grass Creek. The City of Eagle Butte Wastewater Treatment Facility is located approximately 0.5 miles west of the City of Eagle Butte city center; in the Northwest ¼ of Section 18, Township 12 North, Range 24 East, within the Cheyenne River Sioux Indian Reservation in Dewey County, South Dakota. Authorization for discharge is limited to only the outfall specifically listed in the permit.

Public Comments

Comment period ends 40 calendar days after the date of publication of this notice. Comments must be directed to Alysia Tien at the address listed in the box at right. Due to office closures related to the COVID-19 outbreak, at this time there is no opportunity to submit comments via postal mail. If you cannot adequately address comments via email, please reach out to Ms. Tien at (303) 312-7021 to discuss alternative arrangements. All comments received prior to the end of the comment period will be considered in the formulation of any final permit determination and will be part of the administrative record. Any commenter may request a public hearing and the EPA will hold a hearing if the response to this notice indicates significant public interest. The EPA is also requesting comments on the possible adverse effects of reissuing the permit on historic properties and/or cultural resources in the area. The EPA is the Clean Water Act Section 401 certifying authority for this permit, because the Cheyenne River Sioux Tribe has not received authorization to implement section 303(c) of the Clean Water Act. The EPA is also seeking comment on Section 401 certification requirements.

The draft permit and the statement of basis for the draft permit are available for download below. Due to office closures related to the COVID-19 outbreak, at this time there is no opportunity to review the application and related documents in person at an EPA office.
