CAFO for Tarter Gate Wood Products, LLC

The U.S. Environmental Protection Agency (EPA), Region 4, located at 61 Forsyth Street, Atlanta, Georgia, 30303, proposes to issue a Consent Agreement and Final Order (CAFO), Docket No. CWA-04-2020-0502(b), that assesses an administrative penalty of $260,000.00 to Tarter Gate Wood Products, LLC, (Respondent) under the authority of Section 309(g)(2)(B) of the Clean Water Act (CWA), 33 U.S.C. § 1319(g)(2)(B). The CAFO will settle EPA’s allegations that the Respondent made unauthorized discharges of dredged and/or fill material into waters of the United States at a silviculture site located off of Turkey Creek Road near Mintonville, Kentucky, 42516, at latitude 37.171612º N and longitude -84.838838º W, in violation of Section 301 of the Clean Water Act, 33 U.S.C. § 1311. The Respondent’s unauthorized activity impacted approximately 4,600 linear feet of three unnamed tributaries to Turkey Creek, which is a tributary of the Green River, a navigable water of the United States.
