Summary

On December 17, 2020, EPA approved the State of Florida’s request to assume administration of a Clean Water Act (CWA) Section 404 program. EPA conducted its review pursuant to the requirements of the CWA Section 404 and implementing regulations. EPA’s approval is based on consideration of information provided by the State of Florida, comments received during the public comment period and public hearings, and information provided during consultation on Florida’s request. Florida’s Section 404 program for regulating the discharge of dredged or fill material into waters within the jurisdiction of the State as provided under CWA Section 404(g) became effective upon the publication of this approval in the Federal Register on December 22, 2020.
