The U.S. Environmental Protection Agency (EPA), Region 4, located at 61 Forsyth St., S.W., Atlanta, Georgia 30303, proposes to issue an Expedited Settlement Agreement and Final Order (ESA), that assesses an administrative penalty of $40,000 to Van Smith Company (Respondent), under the authority of Section 309(g)(2)(A) of the Clean Water Act, 33 U.S.C. § 1319(g)(2)(A). The ESA will settle EPA’s allegations that the Respondent discharged stormwater associated with industrial activity into waters of the United States without first having obtained coverage under the State of South Carolina’s NPDES General Permit for Storm Water Discharges Associated with Industrial Activities, Permit No. SCR00000 (Permit), in violation of the CWA Section 301,33 U.S.C. § 1311, at its facility located at 1110 Drop Off Dr, Summerville, South Carolina 29483.
EPA is providing public notice of the proposed settlement pursuant to Section 309(g)(4) of the CWA, 33 U.S.C. § 1319(g)(4)(A), and 40 C.F.R. § 22.45. In order to provide opportunity for public comment, EPA will not take final action in these proceedings prior to 40 days after publication of this notice. Comments due by January 9, 2021.
