Certifying RMP process at higher program level

If a process qualifies as Program Level 1, can a facility designate it as a Program Level 2 or 3 in their Risk Management Plan?

No. The owner or operator of a stationary source with a process eligible for Program 1 must certify their Program 1 designation in their Risk Management Plan. However, implementation of Program Level 2 or 3 requirements at the source are at the discretion of the owner or operator.
