Louisiana SIP: LAC 33:III Ch. 13 Section 1307 - Degradation of Existing Quality Restricted

Regulatory Text:
Louisiana Administrative Code, Title 33 ENVIRONMENTAL QUALITY, Part III Air (LAC 33:III)

Chapter 13. Emission Standards for Particulate Matter

Subchapter A. General

Section 1307.  Degradation of Existing Quality Restricted
Approved by EPA 03/08/89 (54 FR 09795) at 52.970(c)(49) effective 05/08/89.

Neither Section 1307 nor Table 3 (at the end of Chapter 13 and cited in Section 1307) are listed in Table A in the March 8, 1989, Federal Register (54 FR 9783) as being approved. However, Chapter 13 was approved.  Also, both Section 1307 and Table 3 are in the materials incorporated by reference.  Table 3 is also cited in Section 1311.  Therefore it is assumed that both Section 1307 and Table 3 are in the SIP.

Emissions whose quality as of the effective date of these regulations is higher than the standards set forth in Table 3 and LAC 33:III.1311.B shall be maintained at the higher quality unless it can be affirmatively demonstrated to the department that a change in quality is justifiable and will not be contrary to the guidelines as set forth by these regulations.
