SECTION 5. VISIBLE AIR CONTAMINANTS

5.01 General
No person shall cause or allow to discharge into the atmosphere, from any source whatsoever, any air contaminants as dark or darker in shade as that designated as No. 1 on the Ringelmann Chart or of such opacity as to obscure an observer's view to a degree equal to or greater than that designated as No. 1 on the Ringelmann Chart, except as follows:
A. Emissions permitted under Section 3 of these Regulations.
B. Where the presence of uncombined water is the only reason for failure to meet the limitation herein.
C. Diesel engines when--
1. Accelerating under a load may emit smoke for a maximum period of 10 seconds which is not as dark or darker in shade than that designated as No. 2 on the Ringelmann Chart or of such opacity as to obscure the observer's view to a degree greater than that designated as No. 2 on the Ringelmann Chart; or when used in vehicles operating off public roads or highways may emit smoke for a maximum period of 15 seconds which is not as dark or darker in shade as that designated as No. 3 on the Ringelmann Chart.
2. When being started cold, may emit smoke for a maximum period of 20 minutes which is not as dark or darker in shade than that designated as No. 2 on the Ringelmann Chart, or of such opacity as to obscure the observer's view to a degree grater than that designated as No. 2 on the Ringelmann Chart.
D. Turbine-type aircraft engines may emit smoke which is not as dark or darker in shade than that designated as No. 2 on the Ringelmann Chart.
E. When dry wood or paper is burned, residential fireplaces are not subject to the provisions of this section.

5.02 Gasoline Engines
No person shall cause or allow the emission of any visible air contaminants into the atmosphere from any four-cycle engine except for a period of five (5) seconds after the engine is started.
