§101.19.  Severability.
 (Approved as Rule 22.)

(Section 101.19 approved by EPA as Rule 22 on 05/31/72 (37 FR 10895) at 52.2270(b) [indicated by “01" below] effective 05/31/72.)

01    If any provisions of any of the regulations of the Texas  Natural Resource Conservation Commission (TNRCC or Commission) or the application of that provision to any person, situation, or circumstance is for any reason adjudged invalid, the adjudication does not affect any other provision of the regulations or the application of the adjudicated provision to any other person, situation, or circumstance.  The Commission declares that it would have adopted the valid portions and applications of the regulations without the invalid part and to this end the provisions of the regulations are declared to be severable.
