Texas SIP: 30 TAC 112.17: Temporary Fuel Shortage Plan Notification Procedures

Section 112.17.  Temporary Fuel Shortage Plan Notification Procedures.

   Any person who operates a source under a temporary fuel shortage control plan filed pursuant to Section 112.15 of this title (relating to Temporary Fuel Shortage Plan Filing Requirements), shall comply with the following notification procedures: 

     (1) The Executive Director and the appropriate local air pollution control agency shall be notified in writing as soon as practicable of a fuel shortage or impending fuel shortage which causes or may cause an excessive emission that contravenes Section 112.3 of this title (relating to Net Ground Level Concentrations), and Section 112.9 of this title (relating to Allowable Emission Rates - Combustion of Liquid Fuel), or any permit requirements.  The notification shall include an estimate of the expected duration of the fuel shortage.

     (2) The Executive Director of the Texas Natural Resource Conservation Commission and the appropriate local air pollution control agency shall be notified in writing as soon as practicable of the termination of a fuel shortage which would allow the resumption of operations in compliance with Section 112.3 of this title (relating to Net Ground Level Concentrations) and Section 112.9 of this title (relating to Allowable Emission Rates - Combustion of Liquid Fuels) and any permit requirements.
