5C5 CONTROL OF REID VAPOR PRESSURE OF GASOLINE

§115.252.  Control Requirements.
 104E   For the El Paso area as defined in §115.10 of this title (relating to Definitions), the following control requirements shall apply.
 104E       (1)  No person shall place, store, or hold in any stationary tank, reservoir, or other container any gasoline, which may ultimately be used in a motor vehicle in the El Paso area with a Reid vapor pressure (RVP) greater than 7.0 pounds per square inch absolute (psia) or that does not meet the U.S. Environmental Protection Agency (EPA) specifications for reformulated gasoline.
 104E       (2)  No person shall transfer or allow the transfer of gasoline, which may ultimately be used in a motor vehicle in the El Paso area with a RVP greater than 7.0 psia or that does not meet EPA specifications for reformulated gasoline to or from any storage vessel or tank-truck tank at any gasoline terminal, bulk plant, or motor vehicle fuel dispensing facility.
 104E       (3)  All adjustments in the operation of affected facilities and all transfers or alterations of noncompliant gasoline must be completed as necessary to conform with the provisions of this rule during the following periods of each calendar year:
 104E            (A)  June 1 through September 16 of each year for motor vehicle fuel dispensing facilities; and
 104E            (B)  May 1 through September 16 of each year for all other affected facilities.

§115.253.  Alternate Control Requirements.
 105P   For all affected persons in the Beaumont/Port Arthur, Dallas/Fort Worth, El Paso, and Houston/ Galveston areas, alternate methods of demonstrating and documenting continuous compliance with the applicable control requirements or exemption criteria in this undesignated head (relating to Control Of Reid Vapor Pressure of Gasoline) may be approved by the executive director in accordance with §115.910 of this title (relating to Availability of Alternate Means of Control) if emission reductions are demonstrated to be substantially equivalent.

§115.255.  Approved Test Methods.
 104E   For the El Paso area, the following testing requirements shall apply:
 104E       (1)  Sampling Procedures for Fuel Volatility (40 Code of Federal Regulations, Part 80, Appendix D); and
 104E       (2)  Tests for Determining Reid Vapor Pressure of Gasoline and Gasoline-Oxygenate Blends (40 Code of Federal Regulations, Part 80, Appendix E).

§115.256.  Recordkeeping Requirements.
 105P   For the El Paso area, the owner or operator of any gasoline storage vessel, gasoline terminal, or gasoline bulk plant affected by the provisions of §115.252 of this title (relating to Control Requirements) shall maintain records of the Reid vapor pressure of all gasoline stored or transferred during the compliance period.  All records shall be maintained for two years and be made available for review by representatives of the executive director, the United States Environmental Protection Agency, and local air pollution control agencies.

§115.257.  Exemptions.
 104E   For the El Paso area, the following exemptions shall apply.
 104E       (1)  Any stationary tank, reservoir, or other container used exclusively for the fueling of implements of agriculture is exempt from the requirements of §115.252 of this title (relating to Control Requirements).
 104E       (2)  The owner or operator of a motor vehicle fuel dispensing facility is exempt from the requirements of §115.256 of this title (relating to Recordkeeping Requirements).
 104E       (3)  Any tank, reservoir, storage vessel, or other stationary container with a nominal capacity of 500 gallons (1,893 liters) or less is exempt from the requirements of §115.252 of this title (relating to Control Requirements).
§115.259.  Counties and Compliance Schedules.
 104E  All affected persons in the El Paso area shall be in compliance with this undesignated head (relating to Control of Reid Vapor Pressure of Gasoline) no later than May 1, 1996.
