In October 2017, EPA proposed to repeal the Clean Power Plan - after completing a thorough review as directed by the Energy Independence Executive Order. EPA proposed a change in the legal interpretation as applied to section 111(d) of the Clean Air Act, on which the CPP was based, to an interpretation that is consistent with the Act’s text, context, structure, purpose, and legislative history, as well as with EPA’s historical understanding and exercise of its statutory authority. EPA held a public hearing and three listening sessions (available in the public docket). The comment period closed April 26, 2018.
