EPA held a public hearing on the decision to grant reconsideration and request comment on five specific issues that were raised in petitions for reconsideration on the Refinery Sector Rule for which EPA did not provide adequate opportunity for notice and comment. Also in this action, EPA proposed amendments to the final rule to clarify a compliance issue and to correct referencing errors.

The Refinery Sector Rule was published on December 1, 2015, and became effective on February 1, 2016. Following finalization of the rule, EPA received three separate petitions for reconsideration. On June 16, 2016, letters were sent to petitioners granting reconsideration on the petitioners’ claims as they relate to aspects of the final rule where the public was not afforded an opportunity for notice and comment.

The hearing was held on November 17, 2016, from 2:00 p.m. – 8:00 p.m. (Central Time).
