Rule Summary

EPA is taking direct final action on updates to the list of North American Industry Classification System (NAICS) codes subject to reporting under Section 313 of the Emergency Planning and Community Right-to-Know Act (also known as the Toxics Release Inventory) to reflect the Office of Management and Budget (OMB) 2012 NAICS revision. Facilities will be required to use 2012 NAICS codes when reporting beginning with TRI reporting forms that are due on July 1, 2014, covering releases and other waste management quantities for the 2013 calendar year.

This direct final rule adds no new reporting requirements, and there will be no net increase in respondent burden.

Rule History

OMB revises NAICS codes every five years. The list of NAICS codes covered by the TRI Program must also be updated.
