Regulatory Requirements for Importers to Participate in the Transition Program for Equipment Manufacturers (TPEM)

Applicable regulations for all importers:

Equipment Manufacturers that Import their TPEM Equipment

Equipment manufacturers that import their TPEM equipment into the U.S:

Companies Importing Equipment Exempted under a Foreign Manufacturer's Valid Allowance

Companies that import TPEM equipment into the U.S. but do not manufacture equipment do not qualify to participate in TPEM on their own. They can only import equipment exempted under a foreign manufacturer’s valid allowance.

Annual reporting requirements:
  • Are different from those of equipment manufacturers.
  • In addition to their own notification and annual reports, importers must submit required notifications and reports on behalf of the original equipment manufacturer(s) and track that allowance limits are not exceeded.
