Findings of Failure to Submit a Clean Air Act Section 110 State Implementation Plan for Interstate Transport for the 2015 Ozone National Ambient Air Quality Standards (NAAQS)

As required by the Clean Air Act, EPA is finding that seven states failed to submit complete interstate transport State Implementation Plans or SIPs for the 2015 8-hour ozone National Ambient Air Quality Standards. Maine, New Mexico, Pennsylvania, Rhode Island, South Dakota, Utah, and Virginia have failed to submit complete plans, which were due on October 1, 2018. Within 2 years, EPA must promulgate a Federal Implementation Plan for these states unless the Agency approves a SIP addressing these obligations from an affected state before then. An EPA finding for an interstate transport plan does not trigger sanctions requirements. EPA is committed to working with these states to expedite the development and submission of their state plan revisions and to ensure continued progress toward cleaner air.
