Offending Air Emissions Testing Bodies

An owner or operator who has requested information from an Air Emissions Testing Body (AETB) under Part 75, Appendix A, §6.1.2(g) who believes that the information provided by the AETB was either incomplete or inaccurate may request the Administrator's assistance in remedying the alleged failure(s). Upon such a request, if the Administrator concurs that the information submitted by an AETB to a source subject to Part 75 is either incomplete or inaccurate, the Administrator will provide the AETB a description of the failure(s) to be remedied. The Administrator's determination of completeness and accuracy of information will be solely based on the provisions of ASTM D7036-04 and Part 75. The Administrator may post the name of the offending AETB on EPA websites if the AETB does not satisfactory respond to the source and email a notification of the response to aetb@epa.gov within 30 days of the Administrator having provided the AETB a description of the failure(s) to be remedied. If, after the AETB's name is posted, the Administrator determines, in consultation with the source, that the AETB's response is sufficient, the AETB's name will be removed from the EPA websites.
