No, that is not our understanding of the June 18, 2020 OMB Guidance (PDF). If EPA provided a recipient whose operations were disrupted by COVID-19 with relief from a requirement based on guidance provided in the March 19, 2020 OMB Guidance or the April 9, 2020 OMB Guidance that relief remains in effect for the period of time EPA specified in granting the request for flexibility. However, if a recipient requests an extension of the relief the authorized EPA official must re-evaluate the need for relief based on current conditions. In some cases, the Office of Grants and Debarment may need to approve a case by case regulatory exception for EPA to continue to provide the flexibility.
