Guidance: Defining "Matters Addressed" in CERCLA Settlements

Memorandum revises the policy regarding the content of contribution protection clauses in judicial and administrative settlements under the Comprehensive Environmental Response, and Liability Act (CERCLA, commonly referred to as Superfund). In many cases it is appropriate for the settlement agreement to contain an explicit definition of "matters addressed" that clarifies the parties' intent regarding the scope of contribution protection. Memorandum describes the principles to be in defining "matters addressed." Issued 3/14/1997.
