Revised Delegation of Authority to Prioritize Superfund Remedial Decisions Estimated to Cost $50 Million or More

To facilitate the more rapid remediation and revitalization of contaminated sites and to promote accountability and consistency in remedy selection, Former EPA Administrator Scott Pruitt issued a revised CERCLA delegation of authority in May 2017, followed by a clarifying memo in April 2018. With this revision, the Administrator retains the authority to select remedies estimated to cost $50 million or more; this authority had previously been delegated to the Assistant Administrator for the Office of Land and Emergency Management and to the Regional Administrators.
