Primacy enforcement authority information

The safe drinking water act mandates that each state must have a UIC program. Many States have been given primary enforcement responsibility (primacy) for their UIC programs. Mid-Atlantic states with primacy:

If a state does not adopt primacy of the UIC program, EPA must implement the program for the state. EPA directly implements UIC programs in:

  • District of Columbia
  • Pennsylvania
  • Virginia

Tribal UIC

EPA Region 3 currently has 7 federally recognized tribes in the Commonwealth of Virginia:
  • Pamunkey
  • Chickahominy
  • Eastern Chickahominy
  • Upper Mattaponi
  • Rappahannock
  • Monacan Nation
  • Nansemond
Currently, EPA has primacy of the UIC program in all 7 federally recognized tribes.
